These Terms of Use (hereinafter referred to as the “Terms”) are intended to define the terms and conditions governing the use of the pers6na.com website (hereinafter referred to as the “Site”), as well as the respective rights and obligations of the parties in this context.
Any use or browsing of the Site implies the User’s full and unconditional acceptance of these Terms (hereinafter referred to as the “User”). If the User does not accept these Terms, they are invited not to use the Site.
These Terms are separate from:
the General Terms and Conditions of Sale, which specifically govern purchases of training programs and reports made through the Site;
the Privacy Policy, which details the processing of personal data.

Article 4 — Access to the Site
The Site is available free of charge to any User with internet access. All costs associated with such access (computer equipment, internet connection, etc.) are borne exclusively by the User.
The publisher uses reasonable means at its disposal to ensure high-quality access to the Site but is under no obligation to guarantee uninterrupted availability. The publisher cannot be held liable for any network or server malfunction, or any other event beyond its reasonable control, that prevents or impairs access to the Site.
The publisher reserves the right to interrupt, temporarily suspend or modify access to all or part of the Site without prior notice, particularly for maintenance operations.
Article 5 — Practitioner Portal (user account)
The Site provides a personal area reserved for accredited PERS6NɅ practitioners (“Practitioner Portal”), accessible using personal login credentials (email address and password).
5.1 Account creation and security
Each accredited practitioner has a personal and non-transferable account. They undertake to:
provide accurate information when creating their account;
keep their login credentials strictly confidential;
inform the publisher immediately of any unauthorized use of their account or any suspected security breach.
The publisher cannot be held liable for consequences resulting from fraudulent use of the account caused by the User’s negligence in protecting their login credentials.
5.2 Use of the account
The Practitioner Portal is strictly reserved for professional use in accordance with PERS6NɅ accreditation (access to diagnostics at the practitioner rate, assessment tracking, debriefing materials). Any misuse, including the resale or sharing of access credentials with non-accredited third parties, is strictly prohibited and may result in suspension or termination of the account, without prejudice to any further legal action.
5.3 Suspension and termination
The publisher reserves the right to suspend or terminate access to the Practitioner Portal in the event of non-compliance with these Terms, the ethical charter of the practitioner network, or failure to renew accreditation within the required timeframe (accreditation is valid for 2 years and renewable through a refresher session).
Article 6 — Intellectual Property
All content available on the Site (texts, the PERS6NɅ model, structure, graphics, logos, icons, layout, databases) is protected by copyright and trademark law and remains the exclusive property of Igor Heres SARL, unless otherwise stated.
Any reproduction, representation, modification, publication, adaptation or extraction of all or part of the Site’s content, by any means or process whatsoever, is prohibited without the publisher’s prior written authorization — except for documents expressly designated by the publisher as copyright-free.
Any infringement of these rights may result in civil and criminal proceedings.
The PERS6NɅ trademark and third-party trademarks mentioned on the Site (MBTI®, DISC®, Process Communication Model®) belong to their respective owners, under the conditions specified on the relevant pages of the Site.
Article 7 — Nature of the Content and Non-Clinical Framework
The Site presents a personality diagnostic intended for informational and professional purposes. As stated throughout the pages describing the Model, PERS6NɅ is a non-clinical and non-diagnostic framework and does not under any circumstances replace an assessment by a healthcare professional.
The User acknowledges that the content available on the Site (reports, articles, resources) does not constitute medical advice, legal advice or individualized professional advice, and should be interpreted with the support of an accredited practitioner.
Article 8 — Liability
The publisher makes every reasonable effort to ensure that the information provided on the Site is accurate and up to date but cannot guarantee the complete absence of errors, inaccuracies or omissions.
The publisher cannot be held liable for:
direct or indirect damages resulting from the use of the Site or the inability to access it;
the content of third-party websites to which the Site may link;
any use of the PERS6NɅ diagnostic or its results outside the framework of a guided debrief conducted by an accredited practitioner.
Article 9 — Hyperlinks
The Site may contain hyperlinks to other websites (e.g. accredited practitioners, partners, resources). The publisher has no control over these third-party websites and accepts no responsibility for their content, availability or personal data practices.
Article 10 — Personal Data and Cookies
The processing of personal data collected through the Site (contact forms, connection requests, creation of practitioner accounts) is described in detail in the Privacy Policy, available by contacting contact@pers6na.com, in accordance with the GDPR.
The use of cookies is also described in the same policy.
Article 11 — Online Sales
The Site allows users to purchase certain services online (training programs, reports). The terms governing orders, payment, withdrawal rights and delivery of these services are detailed in the General Terms and Conditions of Sale, available by contacting contact@pers6na.com. These Terms and Conditions of Sale take precedence over the present Terms of Use in all matters relating to commercial transactions.
Article 12 — Amendments to the Terms
The publisher reserves the right to amend these Terms at any time, particularly in order to adapt them to changes to the Site or applicable regulations. The applicable version is the version in force on the date the User accesses the Site.
Article 13 — Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute and failing an amicable resolution, the competent French courts shall have jurisdiction, subject to any mandatory consumer protection rules applicable to individual Users.
